How to leave a gift in your Will

Leaving a gift in your Will is simple. You can include Arthritis Australia when you write a new Will or add a small amendment (called a codicil) to your existing Will. We recommend speaking with your solicitor or legal adviser to make sure your wishes are recorded correctly.

Types of gifts you can leave

There are a few different ways to structure your gift, and your solicitor can help you choose what suits your circumstances best. 

  • A percentage of your estate (a residuary gift) – anywhere from 1% to 100%, whatever feels right for you. 
  • A specific sum of money (a pecuniary gift) – any amount that suits your situation. 
  • The residue of your estate – what remains after your loved ones have been provided for. 
  • A specific asset – such as property, shares, or other items of value. 

Suggested wording for your Will

It’s important that a bequest is worded correctly so your wishes can be carried out. Below are four suggested wording options you, a family member, or your solicitor can use.
I give and bequeath to the Arthritis Foundation of Australia ABN 67 002 598 594 — trading as Arthritis Australia, in aid of that Foundation and specifically for research [or its general purposes — use whichever is appropriate], the sum of $______ for which the receipt of the Treasurer or other officer shall be sufficient discharge to my Executor for the Bequest.
I give and bequeath to the Arthritis Foundation of Australia ABN 67 002 598 594 — trading as Arthritis Australia, in aid of that Foundation and specifically for research [or its general purposes — use whichever is appropriate], _____ percent (___%) of the residue of my estate, for which the receipt of the Treasurer or other officer shall be sufficient discharge to my Executor for the Bequest.
I bequeath to the Arthritis Foundation of Australia ABN 67 002 598 594 — trading as Arthritis Australia, in aid of that Foundation and specifically for research [or its general purposes — use whichever is appropriate], the rest and residue of my Estate, for which the receipt of the Treasurer or other officer shall be sufficient discharge.

If you already have a Will, you don’t need to rewrite it. A codicil is a simple amendment that lets you add a bequest to Arthritis Australia without changing the rest of your wishes. Your solicitor can prepare this for you.
